Terms & Conditions

4. Hosting

If you order Hosting services they shall be subject to these Terms and Conditions which form part of the full Terms and Conditions of services.

Hosting

  1. The Hosting packages are as detailed on our website and, unless stated otherwise subject to a 12 month billing period.
  2. We shall provide you with –
    1. the Hosting Capacity, within the limits of your selected package,–
      1. within an account on a server that is shared with other customers of ours when you select the Shared Hosting or Reseller packages, without any administrator rights or permission to manage or change the server's configuration; or
      2. on a server for your sole and exclusive use, with administrator rights when you select a dedicated server package, it is deemed that you or a person on your behalf possesses sufficient knowledge and skill to manage the configuration which is subject to guidelines published on our website from time to time unless you request our managed server services and pay the relevant fees as stated on our website.
    2. The ability to upload your Hosted Materials by way of FTP uploads or other similar compatible means within the limits of your available Hosting Capacity.
    3. the ability for your Hosted Materials to be accessed via the internet, subject to –
      1. A ‘Domain name' having been acquired by the Client.
      2. The Hosted Material complies with all applicable Law, statute, regulation, code, standard, our acceptable use provisions and not subject to any Take Down Notice or order from a court.
      3. The monthly Bandwidth limit within your selected package. We shall inform you by email when you are approaching your Bandwidth limit, in the event that you exceed your Bandwidth limit access to your Hosted Material will suspended unless you upgrade your services to increase the Bandwidth; or the month in which your limit is exceeded ends; or agreed otherwise.
      4. Downtime of our equipment for maintenance or repairs. You shall be informed at least 7 days in advance of any downtime for scheduled maintenance that is estimated to take longer than 30 minutes, however in the event of an emergency we may need to carry out unplanned and unscheduled repairs which can result in Downtime without notice.
    4. The ability to manage, access, update or amend your Hosted Materials by way of a web based control panel interface subject to sufficient disk space being available.
  3. Access to your Hosted Materials shall be with a telecommunications connection, in the interest of clarity our services do not include the telecommunications equipment or service needed to access our severs or the hosted material.
  4. Your use of the service is at your sole risk. We are not responsible for any Hosted Material residing in your Hosting Capacity. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers, notwithstanding the use of our additional backup services.
  5. You shall not use programs, code or software which consumes excessive system resources, including but not limited to processor cycles and memory.
  6. You shall not use your Hosting Capacity to store any material that is in breach
    1. of our acceptable use policy.
    2. of any third party intellectual property rights and privileges.
    3. of any policies and procedures which we may publish from time to time.
  7. Where any services are due for renewal we shall endeavour to issue advanced notice of the expiry date, however this does not amount to an obligation, the renewal of services is your sole responsibility and we cannot be held liable in any way whatsoever for your failure to renew any services.
